Terms of Use
 
Please read these Terms of Use (hereinafter to be called: Terms) carefully before using the WatchBank.eu website. Using the WatchBank.eu website indicates your agreement with the Terms. If you do not agree to one or more of these Terms, you may not use the WatchBank.eu website. The Terms are available for inspection in the offices of WatchBank B.V., at 34 Musicalstraat, Almere, the Netherlands, and will be sent to you upon request.
 
General
 
This website was made by WatchBank B.V., having its official office in Almere, Chamber of Commerce registration: 39099982, (hereinafter to be called: “WATCHBANK B.V.”).
 
Permitted Use
 
As user of the WatchBank.eu website you must act and behave in every respect in a manner that may be expected of a responsible and careful internet user. Using the website or its contents for acts or actions that are in violation with the law, public order and morality is not permitted. In particular, the following acts and/or actions are not permitted:
 
(a)    Violation of, or any other acts infringing, the intellectual property rights of WATCHBANK B.V. and/or third parties;
(b)    making offensive, incorrect or misleading remarks;
(c)    distribution of legally banned materials;
(d)    avoiding or removing the security of the website or parts thereof.
 
Without prior written consent from WATCHBANK B.V., you are not allowed to copy, change, distribute or disseminate, apply reverse engineering to, or disintegrate the material available, such as logos, images and text, or use/exploit these in any other manner.
 
You are only allowed to introduce a hyperlink (a technical order) that refers to WatchBank.eu and by which the website WatchBank.eu appears in the context of the website WatchBank.eu, if WATCHBANK B.V. has granted you permission to do so beforehand. Requests to make a hyperlink may be addressed to contact@watchbank.eu
 
If you fail to observe the above permitted use, WATCHBANK B.V. reserves the right to claim compensation from you for the loss ensuing from this prohibited use.
 
Intellectual property rights
 
All intellectual property rights related with www.watchbank.eu rest exclusively with WATCHBANK B.V. and/or third parties engaged by it. Intellectual property rights include copyrights, patents, trademarks, trade names, databank rights, design rights, domain names and other intellectual property rights in the Netherlands or abroad that are related to WatchBank.eu in general, including know-how and business secrets. It is not permitted to change or remove any trademarks or identifying symbols in the material and/or any indications regarding intellectual property rights. In the event of violation of the intellectual property rights of WATCHBANK B.V. and/or its suppliers, WATCHBANK B.V. reserves the right to claim compensation for any loss it incurs.  
 
Sales Policy
  
1.1 PRICES
 
All prices mentioned on WatchBank.eu are including 19% VAT, provisions, transport insurance and other shipment costs and expenses from the selling jeweller to the customer in the Netherlands. 
Other levies or costs will be at the purchaser's expense and are not included in the costs of your watch or the shipment costs.
 
Deliveries to other countries, in particular to non-EU countries, will be surcharged with an appropriate standard fee for transport according to the destination.
 
Subject to other agreements the standard fee for transport to EU countries will be EUR 25 per delivery including postage, packaging, transport and insurance. The standard fee for deliveries to non-EU countries (USA/overseas territories) will be EUR 51.
 
Subject to other agreements, the selling jeweller will be responsible for the insurance covering the purchase price of any delivery. However, in certain cases the selling jeweller reserves the right to charge insurance fees for transport, after informing the customer.
 
Prices are subject to change and offers may be revoked at any time, with or without notification. 
 
 
1.2 PAYMENT
 
If you have a Dutch or Belgian bank account, you can pay via Ideal or MrCash, the payment systems of the Dutch and Belgian banks. From all other countries you can pay via a regular bank transfer or your own online payment system. The account number is: 10.63.19.515 in the name of WatchBank B.V.

1.3 ORDER
 
An order via WatchBank.eu will only be considered after WatchBank.eu received the payable amount. After this, WatchBank.eu will order the selling jeweller to send the ordered product directly to the purchaser. WatchBank.eu will deposit the purchase sum until the transaction has been concluded to the full satisfaction of both the purchasing and selling party.
 
The selling jeweller will retain all property rights until full payment has been received.
 
 
1.4 RETURN POLICY
 
1.4.1  The customer has the right to dissolve the purchase of a watch within seven working days after receipt. The customer is obliged to return the watch in its original packaging, enclosing the original invoice or packing note and indicating the reason for returning it. You must inform WatchBank B.V. of the dissolution and the return of goods via the e-mail address contact@watchbank.eu. If you fail to announce the return of goods in advance, you will not be reimbursed. If the original invoice cannot be provided, or if it has been changed or made illegible, the right of dissolution lapses.
 
1.4.2   If the goods are returned unused, undamaged and in a timely and correct manner, WatchBank will repay the price paid, except the shipment costs, within 30 days after receiving the returned goods, minus 5% administration and handling costs.
 
1.4.3   If the goods delivered via WatchBank are not returned in accordance with the return stipulations in Article 1.4.1., the goods are considered to have been accepted without any objection. 
 
1.4.4   The customer is responsible for returning the watch correctly and safely. The costs of the watch's insured return shipment will be at the customer's expense. The purchase amount minus 5% handling costs will only be repaid to the customer after the jeweller's confirmation to WatchBank that the watch has been received in the same condition as it was sent.
 
1.4.5.  If, in the event of a return of goods, the goods are found to be damaged due to incompetent or negligent use or due to any external force, this loss will be recovered from the customer. In that case, the costs will be deducted from the deposited purchase amount. If the costs of repair exceed this amount, all surplus costs may be passed on to the customer. 
 
1.4.6.   Customers are not allowed to open a watch's casing for whatever reason. If this is discovered, all warranty rights or the right to return the watch will lapse. 
 
 
1.5 WARRANTY
 
Any warranties on the watch are provided by the selling jeweller and/or the watch manufacturer, and never by WatchBank. Warranty issues may be settled directly with the jeweller or the manufacturer, without WatchBank's intervention.
The selling jeweller warrants the authenticity of all goods sold via watchbank.eu.
 
 
1.6 WORLDWIDE SHIPPING
 
Goods that are on stock will be shipped within 24 hours after payment is received. If goods are not on stock, the customer will be notified and shipment will take place within 7 working days after payment is received. 
All goods will be sent by express delivery and will be insured worldwide and without costs for the customer. The shipment period will be between one and three business days. All shipments will be fully insured, without additional costs for the customer.
 
 
1.7 JURISDICTION
 
These General Terms, and all matters related to any order that you place via watchbank.eu, are subject to Dutch law. 
All disputes arising from the Terms between WATCHBANK B.V. and third parties will be brought before the competent court in Amsterdam, the Netherlands.
 
 
1.8 GENERAL TERMS
 
The General Terms of this website shall apply to all orders placed and delivered from WatchBank. Any deviations from the current General Terms will only be valid after we have agreed to them and signed them by hand. We reserve the right to amend the General Terms at any time, with or without notification.
